General Terms and Conditions and Customer Information
I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to contracts concluded between you and us as the provider via our website. Unless otherwise agreed, the inclusion of your own terms and conditions, if any, is expressly rejected.
(2) A consumer in the sense of the following provisions is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity. An entrepreneur is any natural or legal person or a legally responsible partnership that, when entering into a legal transaction, acts in the exercise of their independent professional or commercial activity.
§ 2 Conclusion of the Contract
(1) The subject of the contract is the sale of textiles, accessories, and decorative items.
(2) By placing the respective product on our website, we submit a binding offer to conclude a contract under the conditions stated in the item description through the online shopping cart system.
(3) The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the “shopping cart.” You can access the “shopping cart” at any time via the corresponding button in the navigation bar and make changes there. After clicking the “Checkout” or “Proceed to Order” button (or similar), and entering personal information as well as payment and shipping details, you will be shown an order overview.
If you use an instant payment system (e.g., PayPal, Klarna, Sofort, giropay) as your payment method, you will either be directed to the order overview page in our online shop or to the website of the respective payment service provider. After entering and confirming your payment details, you will be redirected to our online shop, where your order details will be displayed again.
Before submitting the order, you have the opportunity to review, change, or cancel your entries. By submitting the order via the corresponding button, you declare your legally binding acceptance of the offer – the contract is thereby concluded.
(4) Your inquiries for a custom offer are non-binding. We will provide you with a binding offer in text form, which you can accept within 5 days.
(5) Order processing and transmission of all information required in connection with the conclusion of the contract are partly automated by email. You must ensure that the email address you provide is correct and that receipt of the emails is technically ensured.
§ 3 Custom-Made Products
(1) You are required to promptly provide us with all necessary information, texts, or files needed for the individual design of the goods via the online ordering system or by email after the contract is concluded. Our specifications for file formats must be observed.
(2) You are obligated not to submit data whose content infringes on third-party rights or violates applicable laws. You explicitly indemnify us against all claims by third parties, including legal costs.
(3) No content check of the transmitted data is carried out by us. We accept no liability for any errors.
§ 4 Special Agreements on Payment Methods
(Details regarding Sofort, Klarna, and PayPal remain unchanged, as these correspond to your offered payment methods.)
§ 5 Right of Retention, Retention of Title
(1) You may only exercise a right of retention if it concerns claims arising from the same contractual relationship.
(2) The goods remain our property until full payment has been made.
§ 6 Warranty
(1) Statutory warranty rights apply.
(2) Consumers are asked to check the goods upon delivery for completeness and obvious defects and to report any complaints to us and the shipping company as soon as possible. There is no obligation to do so, and failure to do so will not affect your legal warranty rights.
(3) If a product characteristic objectively deviates from the norm, this is only considered agreed upon if you were informed about it before the contract was concluded and explicitly agreed to it.
§ 7 Governing Law
(1) Austrian law shall apply. For consumers, this choice of law only applies to the extent that it does not deprive them of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
